Welcome to Bagibagi! These Terms and Conditions (“Terms”) govern your use of the Bagibagi mobile application (“App”) and services provided by Bagibagi (“we,” “us,” or “our”). By using Bagibagi, you agree to abide by these Terms. Please read them carefully before using the App.

1. GENERAL TERMS

I. Eligibility: You must be at least 18 years old to use Bagibagi. By registering, you confirm that you meet this requirement.

II. Purpose: Bagibagi is a platform for giving and receiving second-hand items for free. No money transactions are involved.

III. Account Registration: You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account.

IV. Prohibited Activities: Users may not:

• Sell, trade, or request money in exchange for items.
• Post prohibited or illegal items (see Section 5).
• Engage in fraudulent or misleading activity.
• Use the platform for spam, harassment, or abusive behavior.

2. PEANUT SYSTEM

2.1 How It Works:

• Users need 1 peanut to contact an item giver and reserve an item.
• When users run out of peanuts, they must list an item for giveaway to earn more peanuts.

2.2 Earning Peanuts:

• Peanuts are earned only by successfully listing an item for giveaway.
• Peanuts cannot be bought, sold, or transferred between users.

2.3 Expiration: Peanuts do not expire, but inactive accounts (no activity for 12 months) may be suspended or deleted.

3. LISTING ITEMS

3.1 Item Requirements:

• Items must be legally owned by the giver.
• Listings must include clear descriptions and images.
• Users must accurately represent the condition of items.

3.2 Item Availability:

• Once an item is given away, the giver must mark it as “Taken.”
• Reposting the same item to gain extra peanuts without giving it away is prohibited.

4. TRANSACTIONS & DELIVERY

4.1 User Responsibility:

• Users are responsible for arranging item pickups or deliveries.
• Bagibagi is not responsible for delivery logistics, damages, or item conditions.

4.2 Disputes:

• Bagibagi does not facilitate dispute resolution but may take action against users violating these Terms.

5. PROHIBITED ITEMS

The following items cannot be listed on Bagibagi:

• Illegal or stolen goods
• Hazardous materials
• Firearms, explosives, and weapons
• Alcohol, tobacco, and drugs
• Live animals
• Adult content or explicit materials
• Personal identification documents or financial data
• Counterfeit goods or intellectual property violations

6. USER CONDUCT & ACCOUNT MANAGEMENT

6.1 Account Suspension or Termination:

• We reserve the right to suspend or terminate accounts that violate these Terms.
• Actions such as repeated rule violations, fraud, or abusive behavior may lead to permanent bans.

6.2 Reporting Violations:

• Users can report misconduct or suspicious activity through the App’s reporting system.
• Bagibagi reserves the right to investigate reported accounts.

7. LIABILITY & DISCLAIMERS

7.1 Platform Limitation:

• Bagibagi is a facilitator only; we do not own, inspect, or guarantee listed items.
• We are not liable for any damage, harm, or loss arising from transactions between users.

7.2 Indemnity:

• Users agree to indemnify Bagibagi from any claims, damages, or legal disputes arising from their use of the App.

8. PRIVACY POLICY

8.1 User Data:

• By using Bagibagi, you consent to our collection and use of your personal data as outlined in our Privacy Policy.
• We do not sell user data to third parties.

8.2 Data Security:

• We take security measures to protect user data but cannot guarantee absolute security.

9. MODIFICATIONS TO TERMS

• Bagibagi reserves the right to update or modify these Terms at any time. Users will be notified of significant changes via the App. Continued use of the App after changes take effect constitutes acceptance of the new Terms.
